Kenyan Court Bars Application of Sexual Offences Provisions in Consensual Cases Involving Minors

A Kenyan court has ruled that parts of the Sexual Offences Act cannot be applied to minors found to have engaged in consensual intercourse. The decision could significantly influence how adolescent relationships are handled in the justice system.

Justice Bahati Mwamuye ordered that two related cases be stayed. The ruling halts proceedings linked to consensual peer relationships involving adolescents.

The case was brought by reproductive rights organisations on behalf of three adolescents. They argued that the law was being misused in consensual situations between peers and failed to distinguish between exploitation and mutual relationships.

Rights groups welcomed the ruling, saying it could reduce unnecessary arrests and prosecutions of adolescents and encourage better youth-friendly policies.

The judgment highlights the need to reform how consensual adolescent relationships are treated under Kenyan law while still protecting minors from exploitation.
